To participate in the Every Day in May Giveaway promotion (the “Promotion”) during the Promotion Period (as defined below): (i) complete a specified daily task to be announced each day here [http://www.mobli.com/teammobli] by Mobli [while (a) maintaining a Mobli user account linked to Facebook, and (b) maintaining at least fifty (50) pieces of content (photos or videos) posted to your Mobli profile;] or (ii) send an email with Mobli Daily Task Promotion Entry in the subject line and with your name, address and email address in the body of the email to [dino@mobli.com] (collectively, the “Entry”). Sponsor shall determine whether entrants have satisfied the daily tasks in its sole discretion. No more than one Entry, per person, per day.
Sponsor’s computer is the official time-keeping device for the Promotion. Time and eligibility of Entry will be determined by Sponsor in its sole discretion. Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different addresses, accounts, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any entrant, the authorized account holder of the email account will be deemed to be the registrant. The “authorized account holder” is the natural person assigned the account by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder. Sponsor shall have the right to determine the identity of a potential winner in its sole discretion.
This promotion begins at 12:01 am PT on May 1, 2012 and ends at 11:59 pm PT on May 31, 2012 (the “Promotion Period”). Sponsor’s computer is the official time-keeping device for the promotion. Entries must be received during the Promotion Period. Email entries must be properly marked as sent during the Promotion Period.
In order to be eligible, participants must be (i) at least the age of majority in their jurisdiction of residence; and (ii) a legal resident of the 48 contiguous United States or the District of Columbia. Void in Alaska, Hawaii, Puerto Rico and the U.S. Virgin Islands, U.S. military installations in foreign countries, and all other U.S. territories and possessions. Employees of Sponsor and its parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible.
Thirty one (31) winners will be selected. One winner will be selected each day during the Promotion Period, with the first drawing occurring on May 2, 2012 and the final drawing occurring on June 1, 2012. Each drawing shall constitute a separate sweepstakes and only those entrants whose entries have been received the prior day will be eligible for the daily drawing. Each winner will be selected by a random-chance drawing among eligible entrants. The chances of winning depend upon the number of entries received. Sponsor will attempt to notify winner by email, U.S. Mail or phone at the address associated with a winner’s entry form, and/or by other means provided within the promotion materials within approximately ten (10) days following the drawing. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or winner’s failure to adequately monitor any email account. Winner must then respond to Sponsor within two (2) days. Should a winner fail to respond to Sponsor, Sponsor reserves the right to disqualify that winner and select a new one in a second-chance random drawing. Except where prohibited, participation in the promotion constitutes participant’s consent to Sponsor’s use of participant’s name, likeness, voice, opinions, tweets, biographical information, and residence for promotional purposes in any media without further payment or consideration. Winner may be required to sign an affidavit of eligibility, liability release and a publicity release that, among other things, will further allow Sponsor to use a winner’s name, likeness, voice, opinions, tweets, biographical information, and residence for publicity and promotional purposes without further compensation where permitted by law.
Each winner will receive one 16GB iPad. Approximate retail value of each prize: $499. The odds of winning a prize depend on the total number of eligible entries received. Winners are solely responsible for any and all federal, state, and local taxes that apply to prizes. No cash or other substitution of prizes is permitted, except at the sole option of Sponsor for a prize of equal or greater value.
By submitting an entry for this Promotion, you agree to abide by these rules and any decision Sponsor makes regarding this Promotion, which Sponsor or its designees shall make in their sole discretion. Sponsor reserves the right to disqualify and prosecute to the fullest extent permitted by law any participant or winner who, in Sponsor’s reasonable suspicion, tampers with Sponsor site, the entry process, intentionally submits more than a single entry, violates these rules, or acts in an unsportsmanlike or disruptive manner.
SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN THE PROMOTION. BY ENTERING THE PROMOTION OR RECEIPT OF ANY PRIZE, EACH ENTRANT AGREES TO RELEASE AND HOLD HARMLESS SPONSOR, FACEBOOK, APPLE AND THEIR SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS, AND EACH OF THEIR RESPECTIVE PARENT COMPANIES AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, ARISING OUT OF PARTICIPATION IN THE PROMOTION OR RECEIPT OR USE OR MISUSE OF ANY PRIZE. No more than the stated number of prizes will be awarded. In event that production, technical, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
This Promotion and the rights and obligations of Sponsor and participants will be governed by and controlled by the laws of the State of New York, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the State of New York, Manhattan County. The parties consent to the jurisdiction of the state courts of New York and federal court located with such state and county with respect to any action, dispute or other matter pertaining to or arising out of this Promotion.
